Family Law Proceedings in Turkish Jurisdiction
When dual nationals or foreign couples residing abroad decide to terminate their marriage in Turkey, proceedings fall under the Turkish Civil Code (TMK).
1. Uncontested Consensual Divorce (Anlaşmalı Boşanma)
If spouses reach full agreement on divorce terms, child custody, alimony, and asset division, a Settlement Protocol (Anlaşmalı Boşanma Protokolü) allows the court to grant a decree in a single hearing.
2. Contested Divorce (Çekişmeli Boşanma)
When disagreements persist, a contested lawsuit must be filed establishing statutory grounds such as severe breakdown of marriage or marital misconduct.
