Lease Agreement Disputes Under the Turkish Code of Obligations

Residential lease contracts in Turkey are governed by protective provisions under the Code of Obligations (TBK).

1. Statutory Rent Increase Cap

Annual rent adjustments are legally tied to the Consumer Price Index (TÜFE) 12-month average. Unilateral excess increases are void.

2. Eviction Proceedings (Tahliye Davası)

Landlords can seek tenant eviction only under specific legal grounds, such as personal necessity or a signed written Eviction Undertaking (Tahliye Taahhütnamesi).
