Resolving Shared Real Estate Ownership Conflicts in Turkey
Shared title deeds (Hisseli Tapu) often lead to deadlocks when co-owners disagree on property sale, lease, or usage terms.
1. Statutory Right of Preemption (Şufa Hakkı)
Co-owners hold a statutory right of preemption over any co-owner’s share sold to a third party, unless formally waived in writing.
2. Dissolution of Co-ownership Lawsuits (İzale-i Şuyu / Ortaklığın Giderilmesi)
When co-owners cannot reach consensus, any shareholder can file a court action to dissolve the co-ownership through judicial auction sale and proceeds distribution.
