Legal Effect of International Divorce Judgments in Turkey

A divorce decree rendered by a foreign court (such as in Germany, the UK, or the US) is not automatically recognized in Turkish Civil Registry records. To update civil status and enable remarriage or property settlement in Turkey, a formal recognition proceeding is necessary.

1. Two Avenues: Civil Registry Application vs. Judicial Action

  • Administrative Registration (Nüfus Müdürlüğü): Applicable if both ex-spouses apply jointly through a Turkish Consulate abroad or local registry office in Turkey.
  • Court Recognition Lawsuit (Tanıma ve Tenfiz Davası): Mandatory when a joint application is not feasible or when dispute exists over custody or alimony.

2. Required Documentation

  1. Original certified copy of the foreign divorce judgment with finality confirmation.
  2. Apostille certification pursuant to the Hague Convention.
  3. Sworn Turkish translations certified by a notary or Turkish consulate.
