Asset Division Under the Statutory Matrimonial Property Regime

Since 2002, the default matrimonial property regime in Turkey is the Participation in Acquired Property (Edinilmiş Mallara Katılma Rejimi).

1. Personal Property vs. Acquired Property

  • Personal Assets (Kişisel Mal): Assets acquired before marriage or inherited/gifted during marriage.
  • Acquired Assets (Edinilmiş Mal): Wealth created through employment, investments, or business during marriage.

2. Equalization Claim (Artı Değer Payı)

Upon divorce, each spouse is entitled to a 50% monetary share of the net value of the other’s acquired property accumulated during the marriage.
